项目摘要

研究初年度となる2022年度は、本申請研究を行うための基礎資料となる、近世中期から後期作成の『道訳法児馬』及びその改訂版等の複数の蘭日辞書、またオランダで刊行された欧州諸国の政治体制あるいは法体制に関する記述が見られるものや、民事・刑事の訴訟法をはじめとした諸法典（箕作阮甫『和蘭律書』等）などといった直接・間接に法体制や法概念にかかわる情報を含む諸テキストの調査、蒐集作業および、これらの史料の各機関における所蔵状況を整理してリスト化の作業を進めた。現時点ではこれは準備作業にとどまるものであるが、近世以来の蘭書翻訳が日本近代法の輪郭形成の前提のひとつをなすという視点については、現在までの成果を踏まえながら、法制史学会東京部会第282回例会の「日本近代法制史と時代区分論」をテーマとするワークショップにてその一部を報告したほか、現在改訂作業を進めている分担執筆の概説テキスト（出口雄一ほか編『概説日本法制史』弘文堂）の報告者担当章に反映を行っているところである。なお、この作業の過程では、オランダ商館員関係者によって作成が行われた日本に関する解説記事（J.F. van Overmeer Fisscher, Bijdrage tot de kennis van het Japansche rijk, 1833）の中に法・権利概念に関する幾つかのキーワードが少なからず含まれていることを確認することができた。同書は天保・弘化年間のオランダ法典翻訳事業にも関与している杉田成卿らによって訳出されていることから、今後はこのテキストの詳細や訳出のあり方についても分析をすすめていきたい。
