In the modern society, discrimination becomes the big problem not only in labor relations, but also in other private law relations. In reference to the Arguments about "das allgemeine Gleichbehandlungsgesetz" in Germany in particular, I established in this study the doctrine of prohibition of discrimination by considering discrimination to be the infringement of right of personality and an infringement of the social participation right not an infringement of the right to equality. According to the theory of duty to protect the fundamental rights, I built the frame to judge the requirements of prohibition of discrimination and its remedies.

在现代社会中，歧视不仅在劳资关系中，而且在其他私法关系中也成为一个大问题。关于在德国尤其是关于“ Das Allgemeine Gleichbehandlungsgesetz”的论点，我在这项研究中确立了禁止歧视的原则，即认为歧视是侵犯人格权的侵权，而不是侵犯社会参与权，而不是侵犯公平权。根据保护基本权利的义务理论，我建立了框架来判断禁止歧视及其补救措施的要求。
